Developer J.G. Petrucci will permanently withdraw plans for a warehouse at the site bordering Cold Spring Creamery Road in Buckingham Township under a stipulation agreement, writes Jeff Werner for the Patch.
“The stipulation, once fully executed and approved by the Bucks County Court, will end all litigation and permanently withdraw the warehouse application with prejudice,” said the township.
Under the agreement, Petrucci may develop up to 40 single-family homes on the industrial-zoned site, designed to align with neighboring properties, while preserving 26 acres as open space.
“This stipulation is not a bait and switch that would allow the warehouse plan to resurface,” said the township. “Rather, the stipulation, if signed by all parties, would require that ‘Petrucci withdraw, with prejudice, the Petrucci application upon receipt of final, unappealable approval of the residential proposal in accordance with this stipulation.’”
One of the warehouse’s main opponents, a grassroots group called No Buckingham Warehouse, said it has secured significant commitments from the developer, including a proposed land swap. This, if completed, would expand the preserved open space to 94 acres, 68 acres more than the original 26, along with significant recreational upgrades to Bush Park.
