Abrams Realty & Development presented its case about the rejection of its Exton Square Mall redevelopment plans to Judge Sarah Black in West Chester, writes Noah Zucker for BisNow.
The West Whiteland Township Board of Supervisors had rejected Abrams‘ plans for hundreds of residential units and mixed-use retail space on the 75-acre property due to community concerns. In response, the company sued.
Abrams’ attorney, Marc Kaplin of Kaplin Stewart, argued against the decision made by the only two board members, Rajesh Kumbhardare and Brian Dunn. The board cited traffic, sewage, and emergency services as their concerns and reason for denial.
Kaplin referred to West Whiteland Planning Commissioner John Weller’s statements about the rejection being unexpected. He also explained that Abrams had met every requirement regarding ordinances and zoning.
Meanwhile, Kilkenny Law’s Alex Baumler represented the board and focused on their right to rejection. Baumler raised that the board was trying to address constituent apprehension, noting the long-term impact that such a large redevelopment would have on the township.
Judge Black listened to both sides, mentioning an idea to go through with the master plan but with added measures to relieve the raised issues.
Now, the verdict is in her hands. The timeline for her decision is uncertain due to her heavy caseload.
