Addiction treatment provider Banyan is suing Wayne-based Actus for allegedly tricking it into signing a fake lease at the former Brandywine Hospital campus, writes John George for the Philadelphia Business Journal.
Banyan Coatesville filed the lawsuit in U.S. District Court in Philadelphia on May 28. It lists Actus Management and its affiliates, Actus Holdings and Actus Healthcare Properties, as defendants.
Actus Management is described as a real estate investment, development, and investment company per its LinkedIn page.
Brandywine Hospital closed for good in January 2022. In March, its owner, Tower Health, sold most of the Coatesville property to Delaware-based Regal Builders for $11 million.
Supposedly, the lease between Banyan and Actus Healthcare Properties was signed on Dec. 19.
According to the lawsuit, the building that Banyan planned to occupy is currently used by a business that is associated with Chicago-based Remedy Medical Properties.
Banyan claims that Actus’ deceptive acts prevented the company from taking possession of the 29,500-square-foot building.
Now, the company is seeking to recover the $386,146 it incurred. This includes lease payments, tenant improvements, operating expenses, and utilities, in addition to court costs and punitive damages.
